MUMBAI: Mohammad Shariful Islam Shehzad, a 30-year-old Bangladeshi national, has applied for bail in the Saif Ali Khan stabbing case. He insists that the charges against him are false and claims that his arrest violated legal procedures.
On January 16, an intruder stabbed Bollywood actor Saif Ali Khan multiple times inside his 12th-floor Bandra apartment. Khan underwent emergency surgery at Lilavati Hospital. Two days later, police arrested Shehzad in connection with the attack.
Legal Arguments for Bail
Shehzad’s plea, filed in a Mumbai sessions court, argues that the investigating agency disregarded Section 47 of the Bharatiya Nagarik Suraksha Sanhita (BNSS). This law ensures that arrested individuals are informed of their rights and the reasons for their detention.
Additionally, Shehzad contends that even if witness statements are accepted as fact, they do not meet the legal criteria for Section 311 of the Bharatiya Nyaya Sanhita (BNS), which applies to robbery or dacoity with intent to cause death or grievous harm.
Investigation Status and Bail Request
Shehzad’s lawyer, Ajay Gawali, stated that authorities have completed all necessary recoveries and discoveries. Since the investigation is almost finished, and only the chargesheet remains to be filed, Shehzad believes further detention is unnecessary.
The court will hear his bail plea on April 1.
